Here’s what you need to know to stay compliant and avoid legal trouble.

🔁 All Transfers Must Go Through an FFL

In New York State, all firearm transfers must go through a licensed FFL (Federal Firearms License) dealer, even if the sale is between private individuals.

That means:

  • You can’t sell or give someone a gun directly — even family members.

  • The buyer must pass a background check and complete ATF Form 4473 at the FFL.

  • The FFL must log the firearm into their acquisition/disposition book and complete a NICS check.

🧾 What the Buyer Needs

To complete a legal firearm transfer, the buyer must:

  • Be at least 21 for handguns, 18 for long guns

  • Present a valid government-issued ID

  • Show a NY State Pistol Permit for handguns or semi-automatic rifles

  • Be legally eligible (not a prohibited person)

🚫 What About Family Transfers?

Many people assume they can "gift" a gun to a spouse or child. In NY, that’s not legal unless:
