Transferring a firearm in New York isn’t complicated — but it does come with strict legal requirements. Whether you're buying a gun online, selling one privately, or sending it to a family member, it must go through the correct legal channels.
Here’s what you need to know to stay compliant and avoid legal trouble.
In New York State, all firearm transfers must go through a licensed FFL (Federal Firearms License) dealer, even if the sale is between private individuals.
That means:
You can’t sell or give someone a gun directly — even family members.
The buyer must pass a background check and complete ATF Form 4473 at the FFL.
The FFL must log the firearm into their acquisition/disposition book and complete a NICS check.
To complete a legal firearm transfer, the buyer must:
Be at least 21 for handguns, 18 for long guns
Present a valid government-issued ID
Show a NY State Pistol Permit for handguns or semi-automatic rifles
Be legally eligible (not a prohibited person)
Many people assume they can "gift" a gun to a spouse or child. In NY, that’s not legal unless:
The firearm is transferred through an FFL, just like any sale
The recipient meets all legal requirements
The correct permits are in place (especially for pistols or semi-autos)

Here’s how to do it legally:
Purchase the firearm and select AT Guns and Gear LLC as your receiving FFL.
The seller ships the firearm to us.
We notify you when it arrives.
You come in with your ID and permit, fill out paperwork, and complete the NICS check.
You take the firearm home — legally and safely.
